Chapter 1: Terms of Use

Article 1 (Scope of Application)

These Terms of Use (hereinafter "these Terms") set forth all matters relating to the use of the recording studio provided by G.B.'s Studio (hereinafter "the Studio"). Customers using the Studio (hereinafter "Users") shall use the Studio only after agreeing to these Terms.

Article 2 (Application for Use)

Users shall apply for use of the Studio through the Studio's booking system, or by telephone, email, or other means. The Studio shall confirm the details of the User's application, and a usage agreement shall be formed only upon the Studio's approval.

  • A reservation shall be deemed confirmed upon issuance of a confirmation notice from the Studio.
  • Once a reservation is confirmed, the User shall pay the applicable fee by the specified due date.
  • The Studio bears no obligation to disclose its reasons if it does not approve a User's application.

Article 3 (Usage Fees)

Usage fees shall be determined based on the fee schedule established by the Studio, according to usage time, plan, and other factors. All listed prices are exclusive of tax, and consumption tax will be added separately.

  • Usage fees include studio and equipment usage fees according to the selected plan. An additional fee applies if you use recording progression/equipment operation (a studio engineer) or a partner engineer.
  • For extended use, an additional fee will apply based on the extension time.
  • Payment of fees shall be made in cash on the day of use, or by bank transfer by the day of use. Please note that credit cards and code-based (mobile) payment are not currently accepted.

Article 4 (User Responsibilities)

In using the Studio, Users shall comply with the following:

  • Handle the Studio's equipment and facilities appropriately, and bear the cost of repair if damage is caused intentionally or through negligence.
  • Not smoke, drink alcohol, use drugs, or engage in any other act that violates laws or regulations on the Studio premises.
  • Not engage in conduct that causes trouble for other Users or Studio staff, including noise, violent behavior, or any other act contrary to public order and morals.
  • Not remove the Studio's equipment or facilities without authorization.
  • Bear full responsibility for all matters relating to the copyright and usage rights of any content recorded or produced at the Studio.

Article 5 (Handling of Equipment and Facilities)

Users shall handle the Studio's equipment and facilities appropriately. If the operation of any equipment or facility is unclear, please be sure to check with staff.

  • If a User damages equipment or facilities intentionally or through negligence, the User shall bear the cost of repair or replacement.
  • The User acknowledges in advance that the Studio may, without prior notice, be unable to provide use of some equipment or facilities due to malfunction, maintenance, or other reasons.
  • Users are responsible, at their own risk, for managing any equipment, software, or other items they bring in, and the Studio bears no responsibility whatsoever for any loss of or damage to such items.

Article 6 (Copyright and Intellectual Property Rights)

Copyright in content recorded or produced at the Studio shall belong to the User. However, intellectual property rights relating to the equipment and facilities provided by the Studio, as well as the Studio's name, logo, and the like, belong to the Studio or its respective rights holders.

  • Users may not use the Studio's name, logo, or the like without authorization.
  • If content produced by a User infringes the rights of a third party, the User shall resolve the matter at their own responsibility, and the Studio bears no responsibility whatsoever.

Article 7 (Prohibited Actions)

Users shall not engage in any of the following actions:

  • Acts that violate laws, regulations, or public order and morals
  • Acts related to criminal activity
  • Destroying, damaging, or soiling the Studio's equipment or facilities
  • Acts that interfere with the Studio's operations
  • Acts that cause trouble for other Users or staff
  • Removing the Studio's equipment or facilities without authorization
  • Any other act the Studio deems inappropriate

If a User engages in any of the prohibited acts listed above, the Studio may suspend the User's use, require the User to leave the premises, and refuse the User's future use of the Studio.

Article 8 (Compensation for Damages)

If a User violates these Terms and causes damage to the Studio or a third party, the User shall be liable to compensate for such damage.

Article 9 (Disclaimer)

The Studio bears no responsibility whatsoever in the following cases:

  • Where the Studio is unable to provide its services due to a natural disaster, war, riot, labor dispute, or other event of force majeure
  • Where the Studio is unable to provide part of its services due to equipment or facility malfunction, maintenance, or other reasons
  • Where the Studio is unable to provide its services due to a defect in equipment, software, or other items brought in by a User
  • Any matter relating to the content, quality, or legal issues of content produced by a User
  • Any damage to a User or a third party (including indirect damages, special damages, and lost profits) arising from a User's use of the Studio

Article 10 (Suspension or Termination of Use)

The Studio may suspend or terminate a User's use of the Studio in the following cases:

  • Where the User has violated these Terms
  • Where the User fails to pay the applicable fees
  • Where the User has interfered with the Studio's operations
  • Where the Studio otherwise determines that continued use is inappropriate

Article 11 (Amendment of these Terms)

The Studio may amend these Terms as necessary. The amended Terms shall take effect once posted on the Studio's website. Where a material amendment is made, the Studio will provide notice on its website.

Chapter 2: Cancellation Policy

Article 12 (Requests for Cancellation or Change)

If a User wishes to cancel or change a confirmed reservation, the User shall promptly notify the Studio. Requests for cancellation or change shall be made by telephone, email, or other means.

Article 13 (Cancellation Fees)

If a User cancels a reservation, the following cancellation fees shall apply:

  • Up to 7 days before the usage date: No cancellation fee (full refund)
  • 6 to 3 days before the usage date: 30% of the usage fee
  • 2 days before through the day before the usage date: 50% of the usage fee
  • On the usage date: 100% of the usage fee (no refund)
  • No-show (cancellation without notice): 100% of the usage fee (no refund)

The cancellation fee shall be deducted from any fee already paid, with the remainder refunded, or, if unpaid, shall be billed to the User.

Article 14 (Refunds)

Where a balance remains after deduction of the cancellation fee, the Studio shall refund the balance to an account designated by the User. Processing of a refund may take approximately one to two weeks.

  • Any refund transfer fees incurred shall be borne by the User.
  • Refunds shall be made only to an account designated by the User; refunds in cash will not be made.

Article 15 (Changes and Postponement)

If a User wishes to change the usage date/time, plan, or other details of a confirmed reservation, the User shall promptly notify the Studio.

  • For a change to the usage date (postponement), no change fee will apply if the request is made by 3 days before the usage date.
  • Change request made 2 days before through the day before the usage date: a change fee of 20% of the usage fee will apply.
  • Change request made on the usage date: changes are not possible (treated as a cancellation).
  • For a change of plan, no change fee will apply if the request is made by 3 days before the usage date. Changes made after that time may be subject to the cancellation fee.

Article 16 (Cancellation by the Studio)

The Studio may cancel a User's reservation in the following cases:

  • Where the Studio is unable to provide its services due to a natural disaster, equipment failure, or other event of force majeure
  • Where the User has violated these Terms
  • Where the Studio otherwise determines cancellation to be unavoidable

Where the Studio cancels a reservation for its own reasons, the Studio shall refund the User the full amount of any fee already paid. However, the Studio bears no responsibility for any other damage incurred by the User.

Article 17 (Handling of Special Cases)

The following cases may be handled differently from the cancellation policy set forth above:

  • Special plans such as a long-term lockout plan
  • Special forms of use such as group use or event use
  • Any other case the Studio determines requires special handling

In the cases above, the Studio shall explain the special handling to the User in advance.

Chapter 3: Other Provisions

Article 18 (Handling of Personal Information)

The Studio appropriately handles Users' personal information in accordance with its Privacy Policy.

Article 19 (Governing Law and Jurisdiction)

These Terms shall be interpreted in accordance with the laws of Japan. The Osaka District Court shall have exclusive jurisdiction as the court of first instance for any dispute relating to these Terms.

Article 20 (Severability)

Even if any provision of these Terms is determined to be invalid or unenforceable, the validity of the remaining provisions of these Terms shall not be affected.
